International Senior Lawyers Project seeks senior-level attorney

International Senior Lawyers Project [ISLP] (www.islp.org), an international NGO based in New York City seeks a senior-level attorney with significant litigation experience including issues related to domestic or sexual violence issues for a 4-6 week assignment in the rural town of Huánuco, Peru. Paz y Esperanza ("Peace and Hope"), a Peruvian civil society group that promotes social justice and the inclusion of the poor and marginalized groups into society, has asked for a volunteer to assist with capacity building of its staff, as well to help provide some basic legal training for the small number of local lawyers, prosecutors, and judges in the community to address a lack of sufficient knowledge of standards and international norms to manage domestic and sexual violence cases. The credit union is alleging that the debt is non-dischargeable because client knew she could not repay the loan at the time she obtained the loan. Client denies these allegations. She claims that she did intend to make payments on the debt, and in fact made payments for a period of about 10 months prior to defaulting. She received an unsolicited phone call from an Irvine company; they promised her a free virtual body scan for diagnostics purposes. Once at the office, she was pressured to sign a 10 year contract for "platinum" annual scans with a $1,995 initiation fee and a $149 annual fee. The company opened a credit line for her, told her the interest rate was 11.5% and that she could pay the full amount off in one year if she made monthly payments of $96. According to a bill she received, the actual interest rate is 23.99%. The business card the client received shows a different company name than the contract she signed. When she called to inquire about the rate discrepancy, the company offered her a free colonoscopy scan. Client would like help getting her money back.

Client is a monolingual Spanish speaker. Client's wages are being garnished for a student loan that he took out 20 years ago to enroll in an auto mechanic vocational program in Los Angeles. Client was led to believe that he was awarded a scholarship, and that he would not have to pay for his classes. Unfortunately, what he signed was not a scholarship award but a promissory note. Client finished the vocational program and received a certificate. Homeowner's Association Dispute, PLC 10-1018661
Client seeks assistance in dispute over who is responsible for a water leak and corresponding repair costs. Client purchased a condo in 2005. In December 2009 a neighbor noticed stains on his living room wall, which adjoins client's kitchen. The HOA chose to investigate the leak and perform repairs from client's side, although kitchen cabinets obstructed the wall and neighbor's unit provided unobstructed access. An HOA memorandum states that leaks "in the wall" are the HOA's responsibility, and the repair plumber hired by the HOA noted that leak was "in the wall." Nevertheless, the HOA denies responsibility and claims that client must pay for all repairs to client's and his neighbor's units, totaling $13,200. Client's kitchen was destroyed during the mold remediation work and remains in a state of disrepair. In the process, client lost a tenant and was forced to leave a job in New Mexico and return to Orange County. Client claims $37,600 in moving-related damages and kitchen repair costs. On June 22, client agreed to non-binding arbitration with the HOA. An arbitration date has not been set. May offer ADR and Litigation experience.

Client is a well educated female who speaks and understands English. In November 2008, a couple with whom client was doing business convinced her to invest almost $50,000 in a home in Detroit. The couple was supposed to complete rehabilitation work on the house and then the house was going to be re-sold for a profit. The rehab work was never done, but client was referred to a real estate agent in Detroit to try to sell the house. The house could not be sold, most likely because the rehab work had not been done, so client was referred to a property manager. The manager found tenants for the property and collected the rent, but never passed the rent on to client. Client does not want to own this house anymore and now understands that this investment was a scam. Client would like assistance pursuing claims against the couple so that she can be rid of the house and so that she can get her money back.

Client was on a waiting list for section 8 housing benefits. In July 2009, before client started receiving benefits, she rented an apartment from landlord. At the time that she signed her year-long lease, she told the landlord that she might have to break the lease early when her section 8 housing benefits were approved. Landlord verbally stated that breaking the lease would not be a problem. In February 2010, client's request for subsidized housing benefits was approved. She gave landlord a 30 day notice of her intention to vacate. Client moved out in March 2010. Landlord sued her for $2,700 pursuant to a liquidated damages clause in their lease agreement and obtained a judgment against her. Client would like an attorney to help her negotiate resolution of the judgment.
